Terms of Service

Welcome to Didder (the "Platform"), made available by BYTESTREAM PY E.A.S. UNIPERSONAL, a private-law legal entity headquartered in Paraguay ("Didder", "we", "us"). These Terms of Service ("Terms") govern the relationship and serve as a contract between us and you, and set out the conditions under which you may access and use the Platform and our web pages, services, applications, products and related content (together, the "Services"). Our Services are made available for private, non-commercial use.
1. Acceptance of the Terms
By accessing and using our Services, you confirm that you are free to enter into a binding contract with Didder, that you accept these Terms and undertake to comply with them. Your access to our Services is also subject to our Privacy Policy, which is hereby incorporated into these Terms by reference. If you do not accept these conditions, do not access or use our Services.
If you access or use the Services on behalf of a company or organization, (a) "you" and "your" mean you and the company or organization, (b) you represent and warrant that you act as an authorized representative of the company or organization, with power to bind it to these Terms, and (c) your company or organization is legally and financially responsible for your access to or use of the Services, as well as for the access to or use of your account by other persons affiliated with your organization.
2. Minimum age
The Services are intended exclusively for persons aged 18 years or older. By using the Services, you confirm that you meet the minimum age specified here. If it comes to our attention that any person under this age is using the Services, we will terminate the account of the user in question.
3. Changes to the Terms
We amend these Terms from time to time, for example when updating the features of our Services or when regulatory changes are introduced. We use commercially reasonable efforts to notify all users of material changes, for example by posting a notice on the Platform, and we update the "Last updated" date at the top of these Terms. Your continued access to or use of the Services after the effective date of the new Terms will constitute your acceptance. If you do not accept the new Terms, immediately stop accessing or using the Services.
4. Your account
- To access the Services, you will have to create an account, providing accurate and up-to-date information and keeping it complete and current at all times.
- Keep your account password confidential. If you know or suspect that another person has accessed your account, notify us immediately by e-mail at support@didderlive.com. You are solely responsible (to us and to third parties) for the activities carried out on your account.
- We reserve the right to disable your account at any time, including if you breach any provision of these Terms or if activities occur that damage or may harm the Services or the rights of third parties.
- You may request the permanent deletion of your account at any time through the page didderlive.com/delete-account or through the support channels. Once deleted, the account cannot be reactivated and the associated content and balances cannot be recovered.
5. Acceptable use
Your access to and use of the Services are governed by these Terms and by all applicable laws and regulations. You agree not to:
- access or use the Services if you do not have the legal capacity to accept these Terms;
- make unauthorized copies of, modify, adapt, translate, disassemble, decompile, reverse engineer or create derivative works of the Services or of any content contained in them;
- distribute, license, transfer, sell, commercialize, rent or lease the Services, in whole or in part, or use them for any unauthorized commercial purpose, including the dissemination of advertising or spam;
- interfere with the proper functioning of the Services or circumvent measures we use to prevent or limit access, including by means of automated information-gathering scripts;
- impersonate any person or organization, misrepresent your identity or affiliation, use another person's account without authorization or create a false identity on the Services;
- intimidate or harass another person, or promote explicitly sexual or violent material or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
- upload, transmit, store or make available: viruses and malicious materials; spam and unsolicited approaches; private information of third parties (addresses, phone numbers, documents, cards); material that infringes copyrights, trademarks or privacy; defamatory, obscene, pornographic, hateful or inflammatory material; material that constitutes, encourages or describes crime, dangerous activities or self-harm; threats of any kind; or any material that, in our sole discretion, is objectionable, limits the use of the Services by other persons or exposes Didder or its users to any harm or liability.
We reserve the right, at any time and without prior notice, to remove or disable access to content that violates these rules of conduct or that is harmful to the Services or to our users. Our automated systems may analyze content to detect spam, malware, fraud and violations of these rules, and to offer personally relevant features, such as personalized search results.
6. Coins, Gifts and Virtual Items
- The Platform makes available virtual items, such as coins and gifts ("Virtual Items"), which may be acquired through the Apple (App Store) and Google (Google Play) app stores, at the prices displayed at the time of purchase.
- Virtual Items are a limited use license within the Platform: they have no monetary value in the real world, are not redeemable for cash, are not transferable between accounts and cannot be sold or exchanged outside the Services.
- Purchases are processed by Apple or Google, depending on your device's store, and are not refundable, except in the cases provided for in the stores' own policies or in applicable law.
- Rewards received by creators, hosts and agencies as a result of gifts received during broadcasts are subject to the rules of the program in force, including identity verification requirements, minimum amounts, deadlines and official redemption channels. We may adjust the program rules by notice on the Platform.
- In the event of account termination for breach of these Terms, the associated Virtual Items and promotional balances may be forfeited, to the maximum extent permitted by law.
6.1. Payments to creators, hosts and agencies
Eligible creators, hosts and agencies may convert gifts and rewards received during broadcasts into redeemable amounts, in accordance with the program in force. To receive payment, you must complete identity verification and register a valid payout method held in your own name (according to the payment methods accepted in your region).
Payments are subject to minimum redemption amounts, processing deadlines, anti-fraud checks and applicable fees and taxes, which may be withheld or deducted in accordance with the law. You are solely responsible for the accuracy of the payout details provided and for any tax obligations on the amounts received. We may suspend, withhold or reverse payments in the event of suspected fraud, chargeback, breach of these Terms or legal requirement, and we may adjust the program rules by notice on the Platform.
7. Didder Content
All content, software, images, texts, graphic elements, illustrations, logos, patents, trademarks, copyrights, photographs, audio, videos, music played and the "look and feel" of the Services, and all intellectual property rights related to them ("Didder Content"), belong to or are licensed to Didder. This content may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed or otherwise exploited without our prior written consent.
Subject to these Terms, you are granted a non-exclusive, limited, non-transferable, revocable, non-sublicensable, worldwide license to access and use the Services, solely for your personal and non-commercial use. You acknowledge that we will have the right to generate revenue from the Services, including, by way of example, from sponsorship shares, promotions and Virtual Items, and that, except as provided in these Terms or in another agreement entered into with us, you will not be entitled to any share of such revenue.
8. User Content
8.1. What it is
Users may upload, publish or broadcast (including by live audio streaming) texts, photographs, videos, sound recordings and the musical works incorporated in them ("User Content"), and may combine their content with elements made available by Didder, such as stickers and Virtual Items. The information and materials in User Content are not verified or approved by us, and the opinions expressed by other users do not reflect ours.
8.2. Your warranties
By submitting User Content, you represent that you are the owner of the content or that you have obtained all the necessary authorizations, releases and permissions from the respective rights holders, including of sound recordings and musical works. All User Content will be deemed non-confidential and non-exclusive.
8.3. The license you grant us
You (or the rights holder) remain the owner of the copyrights in your User Content, however, by submitting it through the Services, you grant us an unconditional, irrevocable, non-exclusive, royalty-free, transferable, perpetual and worldwide license to use, modify, adapt, reproduce, create derivative works of, publish, transmit and distribute that content, and to authorize other users and third parties to do so, in any format and platform. You further grant us a royalty-free license to use your username, image, voice and likeness to identify you as the source of your content. If you are a songwriter or an artist affiliated with a copyright organization, record label or publisher, it is your responsibility to ensure that your use of the Services complies with your contractual and reporting obligations to those entities.
8.4. Moderation and removal
We have the right — but not the obligation — to, at our discretion, cut, edit, remove, restrict or block any User Content that violates these Terms or in response to complaints from other users or third parties, with or without prior notice and without incurring liability. We recommend that you keep copies of your content on your device. If you wish to file a complaint about materials uploaded by other users, contact us by e-mail at support@didderlive.com. It is Didder's policy, in the appropriate circumstances, to disable or terminate the accounts of users who repeatedly infringe copyrights or other rights of third parties.
8.5. Feedback
If you send us ideas, suggestions or materials ("Feedback"), you accept that: (i) we have no obligation to review, consider or implement the Feedback; (ii) the Feedback is submitted on a non-confidential basis; and (iii) you grant us perpetual and unrestricted authorization to use and exploit the Feedback, for any purpose, free of charge and without any attribution.
9. Intellectual property
We respect intellectual property rights and ask the same of you. As a condition for accessing and using the Services, you accept not to use them to infringe any intellectual property rights. We reserve the right, at any time, to block access and/or terminate the accounts of any user who infringes or allegedly infringes copyrights or other intellectual property rights.
10. Indemnification
You agree to defend, indemnify and hold harmless Didder, its parent companies, subsidiaries and affiliates, and each of their respective directors, officers, employees, agents and consultants, from and against any and all claims, liabilities, costs and expenses, including attorneys' fees, arising from your breach of these Terms or from a breach by any user of your account.
11. Disclaimer of warranties
Nothing in these conditions will affect legal rights that you, as a consumer, cannot contractually alter or waive. The Services are provided "as is", without any warranty that they will meet your needs, that they will function in an uninterrupted, timely, secure or error-free manner, or that failures will be corrected. We have the right to change, suspend, withdraw or limit the availability of all or any part of the Platform, at any time and without prior notice.
12. Limitation of liability
Nothing in these conditions excludes or limits our liability for losses that cannot be excluded or limited by law. Subject to the foregoing, we will have no liability to you for:
- any loss of profit (suffered directly or indirectly);
- any loss of goodwill or opportunity;
- loss of data suffered by you; or
- any indirect or unforeseeable loss.
Any other loss will be limited to the amount paid by you to Didder in the preceding 12 months. You are responsible for mobile service charges applicable to your use of the Services, including data usage. Any dispute between you and third parties arising from the use of the Services will exist directly between you and the other party.
13. Termination
These conditions represent the entire agreement between you and Didder regarding the Services, superseding prior agreements. We may suspend or terminate your account in the event of a breach of these Terms. You may terminate your account at any time, in accordance with the Your account section. The Platform contains open-source software, and each program is governed by its own licensing conditions.
14. Notice regarding Apple
These conditions are entered into between Didder and you; Apple is not a party to them. The license granted herein is limited to the personal, limited, non-exclusive and non-transferable right to install the Platform on authorized Apple device(s) owned or controlled by you, for personal and non-commercial use, subject to the App Store Usage Rules. Apple is not responsible for the Platform or its content and has no obligation to provide maintenance or support. If the Platform fails to comply with an applicable warranty, you may notify Apple, which will refund the purchase price, if any; to the maximum extent permitted by law, Apple will have no other warranty obligation. Apple is not responsible for claims related to the Platform, including product liability, legal or regulatory non-compliance, consumer protection or intellectual property infringement. You represent that you are not located in a country subject to a U.S. Government embargo and that you are not listed on any prohibited or restricted parties list. Apple and its subsidiaries are third-party beneficiaries of these conditions, with the right to enforce them.
15. Notice regarding Google Play
By downloading the Platform from Google Play, you acknowledge and accept that, to the extent there is a conflict between the Google Play Terms of Service and the other conditions of these Terms, the Google Play Terms will apply to your use of the Platform downloaded from Google Play, and that Google will have no responsibility for compliance or non-compliance with these Terms by Didder or by you.
16. Governing law and jurisdiction
These Terms will be governed by and construed in accordance with the laws of the Republic of Paraguay. The courts of San Lorenzo, Paraguay, are elected to resolve any disputes arising from these Terms, with express waiver of any other, however privileged it may be. If any provision of these Terms is held invalid by a competent court, it will be removed without affecting the remainder.
17. Identity verification and features
Some features of the Services — such as broadcasting live, participating in creator/host and agency programs, requesting withdrawals and accessing expanded limits — may require you to complete identity verification (facial verification) within the application. Until this verification is completed, such features may be limited or unavailable. Facial verification is biometric data processed with your consent and in accordance with our Privacy Policy.
